These Terms of Use ("Terms") apply to your use of GenderRevealHub.com and its pages, forms and features (the "site" or "service"). "GenderRevealHub", "we", "us" and "our" mean the operator of GenderRevealHub. By using the site or submitting a form, you agree to these Terms and to our Privacy Policy. If you do not agree, please do not use the site.

1. About GenderRevealHub

GenderRevealHub is a free online directory and marketplace that connects expecting moms with independent gender reveal vendors, such as bakeries, cake shops, balloon shops, party stores and online shops. Moms can sign up to plan a gender reveal and get reminders. Vendors can list or claim their business for free.

GenderRevealHub is free for moms and vendors. You pay your vendor directly for anything you order from them.

2. Who can use the site

You must be at least 18 years old to use the site or submit any form. The site is not meant for children, and we do not knowingly collect information from anyone under 18.

You agree to give accurate information and to keep it up to date. If you submit a form for a business, you confirm that you are allowed to act for that business.

3. No medical advice

GenderRevealHub does not provide medical advice, diagnosis or treatment, and nothing on the site is a substitute for advice from your doctor or other qualified health professional. Always talk to your doctor or clinic about your pregnancy and your health.

4. The gender reveal result

The gender reveal result is entered by your doctor, clinic or their staff, not by GenderRevealHub. We pass on the result as it was entered. We do not check it and we are not responsible for its accuracy, or for any mistake made when it was determined or entered.

Medical results are not always certain. Please confirm anything important with your doctor or clinic.

5. Vendors and orders

Vendors listed on GenderRevealHub are independent businesses. They are not our employees, agents or partners. We do not make, sell, deliver or guarantee their products or services.

Any order you place, including its price, payment, delivery, quality, refunds and cancellations, is between you and the vendor. GenderRevealHub is not a party to it. Please contact the vendor directly with any questions or issues about an order.

We do not endorse any vendor. Listing details are provided by vendors or based on public information, and may be incomplete or out of date. Some listings on the site are clearly labeled sample listings shown as examples only; they are not real businesses.

6. Directory listings and how they are shown

The directory is a place for moms and vendors to find each other. Being listed does not mean we recommend, verify or vouch for a vendor, its licenses, its food safety practices or its prices. Please do your own checks before you order.

How listings are shown can depend on things like your city, the category you choose, whether a vendor takes online orders, and whether a vendor referred you to GenderRevealHub. A vendor who referred you, for example through its QR code, is shown first when you choose a vendor. If we ever show paid or promoted placements, we will label them.

Vendors may not refuse service or treat moms differently based on race, color, religion, national origin, sex, sexual orientation, gender identity, disability or any other characteristic protected by law.

7. Vendor listings

If you list or claim a business, you agree that:

  • The information you submit (business name, contact name, email, phone, city, category, website and whether you take online orders) is accurate and that you are allowed to submit it.
  • All listings are reviewed and approved by GenderRevealHub before they appear. We may approve, edit, decline, hide or remove any listing at our discretion. To claim an existing listing, we may ask you to verify that the business is yours.
  • You will keep a mom's gender reveal result and personal information confidential, and use them only to plan and fulfil her gender reveal order and to communicate with her about it.
  • You are responsible for your products, services, prices, permits, taxes and compliance with the laws that apply to your business.

8. Information and content you submit

You are responsible for anything you submit to GenderRevealHub, including form entries, listing details, messages and, if we add them in the future, reviews or other posts. You confirm that you have the right to submit it, that it is accurate, and that it does not break any law or anyone else's rights.

You keep ownership of what you submit. You give GenderRevealHub a non-exclusive, royalty-free, worldwide license to host, display, copy, edit for length or format, and promote vendor listing information on the site and in our marketing of the directory. This license does not apply to a mom's gender reveal result, which is handled only as described in our Privacy Policy.

We do not currently publish reviews. If we add reviews or other public posts, they must be honest and based on real experiences, must not be paid for or written by a competitor, and may be moderated or removed. We may remove any submitted content that we believe breaks these Terms.

9. Reminders and messages

When you sign up as a mom, you agree to receive email and, if you give your mobile number, SMS reminders about your appointment and your gender reveal. Message and data rates may apply. Message frequency varies.

You can stop SMS messages at any time by replying STOP. You can unsubscribe from emails using the unsubscribe link in any email, or by writing to hi@genderrevealhub.com. Mobile carriers are not liable for delayed or undelivered messages.

Vendors who submit a listing agree that we may contact them by email or phone about their listing.

10. Ads, partner offers and paid features

The site may show ads and offers from us, from vendors and from other partners. We may also offer optional paid upgrades or extras in the future. Any fee will be shown to you before you pay, and you never have to buy anything to use the free directory.

Offers from third parties are their responsibility, and their own terms apply.

11. Acceptable use

You agree not to:

  • submit false, misleading or someone else's information, or impersonate any person or business;
  • submit spam, or use the site to send unsolicited messages;
  • try to see a gender reveal result that is not meant for you;
  • scrape, copy or harvest listings or personal information from the site;
  • interfere with the site's security or operation, or upload malicious code; or
  • use the site in any unlawful way.

12. Our content

The GenderRevealHub name, logo, design and site content belong to us or our licensors. You may use the site for your own personal or business use as described in these Terms, but you may not copy, sell or reuse our content without our permission.

Information you submit is covered in the "Information and content you submit" section.

13. Third-party sites and services

The site may link to vendor websites and other third-party sites, and relies on our trusted service providers, such as our hosting providers, to run the website and its sign-up and listing forms. We are not responsible for third-party sites, their content or their practices.

If you believe content on the site infringes your copyright, email hi@genderrevealhub.com with your contact details, a description of the work, the page where the content appears, and a statement that you believe in good faith the use is not authorized. We will review the request and remove content where appropriate.

15. Disclaimers

The site is provided "as is" and "as available". To the fullest extent allowed by law, we make no warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose and non-infringement. We do not promise that the site will always be available or error-free, that a reminder or result will be delivered at a particular time, or that any vendor will be available or will fulfil an order.

16. Limitation of liability

To the fullest extent allowed by law, GenderRevealHub and its owners, team and service providers will not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of profits, data, goodwill or other intangible losses, arising from or related to your use of the site, any vendor's products or services, or any gender reveal result.

To the fullest extent allowed by law, our total liability for any claim relating to the site is limited to the amount you paid us for the service in the 12 months before the claim, or US$100 if you paid us nothing. Some places do not allow certain limits, so some of these may not apply to you.

17. Indemnity

You agree to defend and hold harmless GenderRevealHub from claims, losses and costs (including reasonable legal fees) arising from your breach of these Terms, information you submit, or, for vendors, your products, services and dealings with customers.

18. Ending your use

You may stop using the site at any time. We may suspend or end access to the site, or remove any listing or submission, if we believe these Terms have been broken or to protect users, vendors or the site.

19. Governing law

These Terms are governed by the laws of the State of Delaware, USA, without regard to its conflict-of-law rules. Any dispute will be brought in the state or federal courts located in the State of Delaware, unless the law where you live requires otherwise.

20. Resolving disputes

If you have a concern or dispute with GenderRevealHub, please email hi@genderrevealhub.com first and describe the issue and what you would like us to do. We will try in good faith to resolve it informally within 30 days before either of us starts a formal legal claim. Disputes about an order with a vendor should be raised with that vendor.

21. Changes to these Terms

We may update these Terms from time to time. We will post the new version on this page and change the "Last updated" date. If you keep using the site after a change, you accept the updated Terms.

22. General terms

These Terms and our Privacy Policy are the whole agreement between you and GenderRevealHub about the site. If any part of these Terms is found to be unenforceable, the rest stays in effect. If we do not enforce a part of these Terms, that is not a waiver. You may not transfer your rights under these Terms; we may transfer ours as part of a business change. If you use the site from outside the United States, you are responsible for following your local laws.
